This website (rosyscraftstore.com) is operated by Rosys Craft Store (“we”, “us”, or “our”). By visiting the Site and/or purchasing from us, you agree to these Terms of Service (“Terms”), including policies referenced here such as our Privacy policy, Cookie policy, Shipping & returns, and Membership Terms (when you subscribe).

Please read these Terms carefully. If you do not agree, do not access or use the Site. We may update these Terms by posting a revised version on this page. Your continued use after changes are posted constitutes acceptance. It is your responsibility to review this page periodically.

1. Eligibility

By using the Site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us consent to allow any of your minor dependents to use the Site.

You may not use the Site for any illegal or unauthorized purpose, or violate any laws in your jurisdiction (including copyright laws). You must not transmit worms, viruses, or any code of a destructive nature.

2. Accounts

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and update it as needed. We may suspend or terminate accounts that violate these Terms, our prohibited uses (section 10), or appear fraudulent or abusive.

3. Products, pricing, and handmade goods

We offer handmade 3D pop-up cards and related products. Photos and descriptions are provided for shopping guidance. Because items are handmade, small variations are expected and are not defects.

We try to display colors accurately, but we cannot guarantee that your device will show colors perfectly. Prices, stock, availability, and product details may change without notice. We may limit quantities, discontinue products, or refuse any order at our discretion.

Offers are void where prohibited. Product purchases are also subject to our Shipping & returns policy.

4. Orders, billing, and payment

You agree to provide current, complete, and accurate purchase and account information for all orders, including a valid email and shipping address. Payments are processed by Stripe. We do not store full payment card numbers on our servers.

Applicable state and local sales taxes (including Texas sales tax where due) are calculated and applied at checkout based on the shipping destination and tax rules processed through Stripe Tax. The amount due is shown before you confirm payment.

We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers or resellers, that look fraudulent, or that include custom text we refuse under section 10. If we change or cancel an order, we may attempt to notify you using the contact details you provided.

Occasionally the Site may contain pricing, tax, shipping, or availability errors. We may correct errors and cancel or adjust orders even after you submit them, as permitted by law.

5. Shipping and returns

Shipping methods, regions, timelines, and our returns stance are described in Shipping & returns. Sales of our handmade products are Final Sale. We do not accept returns unless we expressly state otherwise. Items with custom text or personalization are non-refundable as described in that policy.

Delivery ETAs are carrier estimates. Once a package is handed off to the post office or carrier, we are not liable for weather, carrier delays, or lost packages beyond the help described in Shipping & returns. If something is wrong with an order, contact us promptly so we can help.

6. Membership subscriptions

Some plans are sold as recurring monthly memberships. Billing, benefits, store credit, cancellation, and related rules are in our Membership Terms. By starting or upgrading a membership, you agree to those Membership Terms.

7. Optional tools and third-party services

The Site may use or link to third-party tools and services (for example Stripe checkout components, Google sign-in or address autocomplete, Cloudflare Turnstile, optional analytics, Etsy, or Instagram). Those services are provided by third parties. We do not control them and are not responsible for their content, availability, or practices.

Optional analytics tools (such as Google Analytics and Microsoft Clarity) load only if you accept optional cookies through our cookie banner or Cookie settings, as described in our Cookie policy.

Your use of third-party services is at your own risk and subject to those parties’ terms and privacy policies.

8. User comments and feedback

If you send creative ideas, suggestions, proposals, or other materials (“comments”), you agree that we may use them without restriction and without compensation or obligation to keep them confidential or respond. Unless agreed upon otherwise.

You agree your comments will not violate any third-party rights or contain unlawful, abusive, or harmful material. You are solely responsible for your comments.

9. Personal information

Submission of personal information through the Site is governed by our Privacy policy.

California and other U.S. residents may have privacy rights described in that policy, including choices about optional analytics cookies through our cookie banner and Cookie settings in the Site footer.

10. Prohibited uses

In addition to other prohibitions in these Terms, you may not use the Site or its content to:

• Engage in any unlawful purpose or solicit unlawful acts.
• Violate any applicable laws or regulations.
• Infringe our intellectual property rights or those of others.
• Harass, abuse, defame, intimidate, or discriminate based on protected characteristics.
• Submit false or misleading information.
• Submit custom text or personalization that is offensive, hateful, harassing, unlawful, or that infringes another person’s rights.
• Upload or transmit viruses or malicious code.
• Collect or track personal information of others without authorization.
• Spam, phish, crawl, scrape, or interfere with security features of the Site.

We may refuse or cancel orders that include prohibited custom text. We may terminate or suspend your access for violating these prohibited uses or for fraud or abuse, as described in sections 2 and 16.

11. Intellectual property

Designs, product photos, branding, site content, and related materials belong to Rosys Craft Store or our licensors. You may not copy, reproduce, sell, or exploit any portion of the Service for commercial purposes without our prior written permission.

12. Disclaimer of warranties

The Site and products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.

We do not guarantee that use of the Site will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable.

13. Limitation of liability

To the fullest extent permitted by law, Rosys Craft Store and our owners, employees, affiliates, agents, contractors, and service providers will not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost data, or similar damages, arising from your use of the Site or products purchased through the Site.

Because some jurisdictions do not allow certain limitations, our liability in those places is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Rosys Craft Store and our owners, employees, affiliates, agents, contractors, and service providers from any claim or demand (including reasonable attorneys’ fees) arising out of your breach of these Terms or your violation of any law or third-party rights.

15. Severability and entire agreement

If any provision of these Terms is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

These Terms and the policies referenced on the Site constitute the entire agreement between you and us regarding the Site, and supersede prior agreements relating to the same subject. Our failure to enforce any right is not a waiver of that right.

16. Termination

Obligations incurred before termination survive termination. You may stop using the Site at any time. We may terminate or suspend access without notice if you violate these Terms, including the prohibited uses in section 10, or for fraud or abuse. You remain responsible for amounts due up to termination.

17. Governing law

These Terms and any separate agreements under which we provide services are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules.
